When you own a car, the responsibilities that come with it include insurance coverage. It’s absolutely necessary to have at least liability insurance to protect yourself in case you cause any accident. More importantly there is proposition 213, a California law that was passed in 1996 by ballot initiative that impacts people who drive without liability insurance coverage, with limited exceptions. The law prevents uninsured drivers who don’t have liability insurance from collecting compensation for non-economic losses, including pain and suffering, even if it’s not their fault!

When you don’t have insurance and someone at-fault hits you while you are driving your uninsured vehicle, you will be unable to collect for any pain, suffering, or for your physical injuries. Yes it’s true believe it or not. The only thing you may be able to recover is property damage, medical bills, and loss of earnings. Finding legal representation in this scenario is also very difficult. Now, here are the important exceptions to this law called proposition 213. First, if you are hit by a drunk driver, who is convicted for it, proposition 213 doesn’t apply. Secondly, if you are a passenger in a car then proposition 213 doesn’t apply. Last exception where this law doesn’t apply is if you are a pedestrian. So, all of these exceptions don’t apply even if you don’t have liability insurance on your car.
