If you have valid legal grounds for a case, you can hire a personal injury attorney on a contingency fee basis. This basically means that the attorney is taking the job on spec. They will cover the expenses associated with preparing your claim for negotiation or litigation, and you will only have to repay them and pay their attorney fees if and when they win compensation for you. Contingency Fee Representation and Your Settlement

If you win your case and your attorney is working on a contingency fee basis, here’s what will happen:

  • Your attorney will take a percentage of your settlement as their fee. Most attorneys take about a third of the total settlement as their fee. The specific percentage that will apply to your case will be spelled out in your contract.
  • You will reimburse your attorney for their expenses. Court filing fees, process server fees, expert witness fees, deposition transcript costs, and other expenses that your attorney covered during the preparation of your case will be reimbursed out of your share of the settlement.
  • You will take the remainder of your compensation as a lump sum or structured settlement.
