Contingency fee representation removes the risk from hiring a personal injury attorney
Have you been injured in any kind of personal injury accident? You probably already realize that you are entitled to compensation for your medical bills, lost wages, pain and suffering, and other damages. But you may be unsure as to whether your case justifies hiring a personal injury attorney.
There are very limited circumstances in which it might be advisable to proceed without the assistance of an attorney. Unless your damages were very small, and/or the defendant has already offered you a settlement that covers all current and future costs associated with your injury, it is worth hiring an attorney.
You can consult a personal injury attorney for free.
If you are unsure whether you want to hire a personal injury attorney, the best thing to do is make an appointment for a free initial consultation. At The Law Offices of Larry H. Parker, we offer free consultations where we will go over the basic facts of your case, advise you on whether you have grounds for legal action, and explain how we can help you win your case and maximize your compensation.
If you do decide to hire a personal injury attorney…
You should never pay up front.
If you have valid legal grounds for a case, you can hire a personal injury attorney on a contingency fee basis. This basically means that the attorney is taking the job on spec. They will cover the expenses associated with preparing your claim for negotiation or litigation, and you will only have to repay them and pay their attorney fees if and when they win compensation for you. If they do not win your case, you will not owe them a single dollar.
Contingency Fee Representation and Your Settlement
If you win your case and your attorney is working on a contingency fee basis, here’s what will happen:
- Your attorney will take a percentage of your settlement as their fee. Most attorneys take about a third of the total settlement as their fee. The specific percentage that will apply to your case will be spelled out in your contract.
- You will reimburse your attorney for their expenses. Court filing fees, process server fees, expert witness fees, deposition transcript costs, and other expenses that your attorney covered during the preparation of your case will be reimbursed out of your share of the settlement.
- You will take the remainder of your compensation as a lump sum or structured settlement.
