For a variety of reasons, applications for disability payments are frequently rejected.

The SSA Might Conclude:

  • The illness does not fit the criteria for a disability.
  • The claim is not supported by medical data.
  • The application has inaccuracies and omissions.
  • The candidate failed to pass the work credits requirement (SSDI).

When an initial claim is denied, the SSA sends a notice explaining why and informing the applicant of his or her right to appeal.

The first step is to submit a Reconsideration Request within 60 days of receiving the denial letter. An SSA consultant and a disability examiner who was not involved in the initial claim will reexamine the claim during the reconsideration stage.

Less than 20% of Social Security disability claims are approved at the reconsideration stage. If a reconsideration claim is denied, the next step is to request a disability hearing, which requires the assistance of the Disability Lawyers at The Law Offices of Larry H. Parker for best results.

What Happens at Social Security Disability Hearing in California?

Disability hearings are held at a Social Security Administration hearing office. An Administrative Law Judge presides over the hearing (ALJ). The ALJ is not a typical Judge. The ALJ only considers Social Security disability cases and is authorized to rule on these claims based on disability law considerations.

The only people present at a disability hearing are you, your Social Security disability lawyer, the ALJ, and any witnesses (medical and/or vocational experts that can elaborate on your medical records and ability to perform work).

The ALJ begins the hearing by introducing the participants and reading a statement of facts regarding the benefit claim. The ALJ will then ask you questions about your condition, disabilities, treatment, work history, and disability-related limitations. Preparation and advice from our Disability Lawyers on these questions is essential to a positive outcome. Furthermore, the ALJ will provide your Disability Lawyer the opportunity to ask additional questions that can further strengthen your case and give you a better opportunity to obtain a favorable decision.

During the hearing, no decision on the claim will be made. Instead, generally within 60 to 90 days of the hearing date, you will receive written notice of the ALJ’s decision. While the ALJ is not required by law to follow Social Security’s previous determinations and must evaluate the claim from a new perspective, it is critical that we provide the ALJ with a complete record of your medical condition.

It is important to note that a disability hearing is not the final stage of the claims process. If your claim is denied, you can request review by the Appeals Council.

Please do not try to navigate the complex world of disability law alone. If you lose your case, you may lose your opportunity to receive benefits that will allow you to maintain a comfortable standard of living.
