Reports indicate that Johnson & Johnson will pay over $4 billion to settle outstanding DePuy hip implant recall lawsuits. This would be the largest ever legal settlement for medical devices in the United States. There are currently about 12,000 lawsuits pending in state and federal courts for defective DePuy hip implants, with this settlement resolving more than 7,500.

According to sources involved in the deal, Johnson & Johnson is expected to pay an average of $300,000 for each defective implant. The deal does not include patients whose hips may fail in the future, but does not bar those victims from seeking compensation.

This agreement would be the second multibillion dollar settlement involving Johnson & Johnson this month (J&J to Pay Over $2.2 Billion to Settle Risperdal Claims).

The deal may be nullified if 6% of eligible victims do not participate in the settlement. Victims may believe that the offer from Johnson & Johnson isn’t acceptable (Jury Awards Hip Implant Patient $8.3 Million).

93,000 DePuy ASR Hip Implants were recalled in August of 2010. The product experienced an unacceptably high 12% failure rate within five years, requiring revision surgeries. Internal Johnson & Johnson documents show failure rates as high as 44% within seven years. The company advertised that these hip implants would last 20 years.
