The Insurance Institute for Highway Safety reports that most children related deaths occur among children traveling as passengers. (IIHS) A 23-year-old man was sentenced earlier this week to 7 years in prison for driving under the influence of alcohol. The driver also plead guilty to causing injury, driving with a blood-alcohol level exceeding the legal limit of .08 percent, and two counts of child abuse and endangerment. All of these count as felonies.

(IIHS) A 23-year-old man was sentenced earlier this week to 7 years in prison for driving under the influence of alcohol. The driver also plead guilty to causing injury, driving with a blood-alcohol level exceeding the legal limit of .08 percent, and two counts of child abuse and endangerment. All of these count as felonies.

The driver slammed an SUV into a tree on the northbound 55 freeway. The driver also admitted to allegations of inflicting ‘great bodily injury and causing great bodily injury on a child younger than 5.’ While the death and injury rates of children under the age of 13 have declined tremendously, they represent 3% of motor vehicle crash related deaths.

When CHP Officers arrived at the scene of the fiery crash, they saw the driver lying on the ground, his panic-stricken toddler, the driver’s wife who was stuck in the front passenger seat, and heard a baby crying in the back seat who was injured.  Fortunately, all passengers and the driver survived, but with injuries. Both the driver and his wife were arrested, pleading guilty to driving under the influence of alcohol, driving on a suspended license as well as resisting arrest.

The State of California has strict drunk driving laws for those who drive under the influence of alcohol. Anyone driving a vehicle is prohibited from driving with a .08% BAC or higher. In the case above, the driver was accused of driving with a blood-alcohol level of .20. (DUI.Driving)
