Strict regulations govern how big rigs can be loaded, and if those rules are violated, it may be a basis for a lawsuit.

The Danger of Truck Load AccidentsWhen most people think about truck accidents, they may envision an out of control 18 wheeler barreling down the highway, wreaking havoc.  Or perhaps they picture a semi truck colliding with another vehicle as it makes a tight turn.  These types of incidents are not necessarily uncommon; big rigs and other large commercial vehicles are responsible for a number of serious and even fatal car accidents on American roads.

However, there is another way that trucks may cause accidents — and it’s one that you may not have been aware of before.  In the United States, the trucking industry is tightly regulated by both state and federal governments.  One aspect of this regulation is controlling what trucks can carry, including the total load size, and the method in which they are carried.  If trucking companies violate these laws or are otherwise negligent, they could be held responsible for any injuries that occur.

There are also regulations that govern how loads are secured on trucks.  If a truck driver fails to properly secure a load, then the results could be disastrous.  For example, consider a big rig carrying large metal pipes to be used in a construction project.  These pipes may be stacked up, and then tied down with straps.  If one of the straps isn’t fastened correctly, or if the strap otherwise fails, then the pipes are at risk of coming loose.  They could then roll off the truck, crushing or otherwise seriously damaging vehicles around it.

An overloaded truck can also be incredibly dangerous, as exceeding the maximum weight capacity of the truck could lead to its brakes failing or other problems.  A skilled truck accident attorney can investigate whether or not the truck was overloaded, improperly loaded or failed to comply with trucking regulations.  If any of these factors are present, it may form the basis of a lawsuit against the truck driver, trucking company or even the manufacturer of the system meant to secure the load.
