Have you or a loved one suffered hearing loss while in the military? If so, it may be the result of defects in earplugs issued to the U.S. Department of Justice by the 3M Company. At The Law Offices of Larry H. Parker we have experience with complex cases like this one and look forward to helping you through the process.
The 3M Company Has Agreed to Pay More Than $9 Million to Resolve These Allegations
In July of 2018, the DOJ announced that 3M had agreed to pay more than $9 million to resolve allegations regarding their earplugs. They were the sole provider of earplugs to the military from 2003 and 2015 and those earplugs have found to be ineffective by not offering a tight fit within the ear. With the poor fit came poor performance and our military personnel’s hearing was put at risk.
The 3M Company Knew Their Earplugs Were Flawed
It was no accident that our servicemembers were put at risk with these faulty earplugs. According to the lawsuit in which 3M agreed to the $9.1 million settlement, they knew that their earplugs were not long enough to be properly inserted in to the ear. They knew that the potential consequence could be slight loosening that was undetectable to the wearer, but which rendered the earplugs ineffective. The company did not disclose this known problem with the military.
Hearing Loss for our Military Personnel is More Common Than Many Realize
Nearly six out of ten military personnel say they have some level of hearing loss after leaving the military. There are nearly 1 million veterans who are currently receiving disability in whole or part due to hearing loss, and more than 1.3 million who have received some type of compensation for ringing in the ears known as tinnitus.
According to a report by the Department of Veteran Affairs, hearing loss and tinnitus are actually the most common service-related disability American veterans suffer with. There are a number of ways hearing loss can occur, including from a single exposure to a very intense impulse or to repeated exposure to softer impulses. For either issue, earplugs should be an important line of defense.
Do You Qualify for Compensation via the 3M Lawsuit?
If you were a member of the military between 2003 and 2015, were issued 3M combat earplugs, and have experienced any of these symptoms then you may be eligible for compensation under the 3M lawsuit:
- Hearing loss
- Ringing in the ears / tinnitus
- Auditory process disorder (APD)
