In Arizona, tipped workers may be paid less than the minimum wage if their supplementary tip income brings the gross hourly wage up to the minimum wage level. In California, employers are required to pay the minimum wage, regardless of their employees’ tip income. Arizona has a 2008 minimum wage rate of $6.90/hr and will increase annually. California has a 2008 minimum wage of $8.00/hr.
Tip Pooling
In California, managers, supervisors, and owners are not eligible to receive any share of tip revenue. Tip pooling is an accepted practice where all tips are combined and distributed equally amongst workers. But, if management takes a portion of tip revenue, reducing your share, you may be entitled to back pay and damages. A tip pooling case involving Starbucks was recently decided.
Unpaid Bonuses
Contractual bonuses are guaranteed as long as the requirements of the contract are fulfilled. When an employer fails to provide a bonus required by contract, the employer is violating wage and hour law.
