Sexual Harassment
Sexual harassment is a unique type of employment discrimination. Discussing sexual harassment in the workplace is sometimes considered taboo. Sexual harassment typically falls in to two categories: quid pro quo sexual harassment and sexual harassment resulting in a hostile work environment.
Quid pro quo sexual harassment is where a worker must tolerate the harassment or risk consequences, such as not getting a raise, not getting a promotion, or losing the job. Examples of quid pro quo harassment could include employment threats or rewards of a sexual nature, such as a manager telling an employee "If you go out with me this Friday, I will let you take Monday off" or "If you don't go out with me this Friday, you will be fired". A sexual harassment claim can be valid after only one incident of quid pro quo harassment.
A hostile work environment is any work environment where an employee's ability to do his or her job is affected by constant harassment or abuse. Repeated episodes of sexual harassment, including unwanted advances, inappropriate requests, or other unwelcome physical or verbal incidents can constitute a hostile work environment. It's important to know that the aggressor must first be aware that his or her actions are unwelcome before a hostile work environment can be claimed. Ignoring the incidents can only make the situation worse. Be sure to make a complaint to management, or if management is the aggressor, someone else who is capable of handling your complaint. Retaliation against employees that file sexual harassment claims is explicitly forbidden by the law.
