Management workers are not required to be paid overtime. Questions can come up, however, when employees are given management job titles without actual management functions and responsibilities. Real managers are in a supervisory role and have the ability to influence personnel decisions. Employers are prohibited from adding a manager title to a position that does not have manager functions for the sole purpose of not paying that position overtime.
Overtime Guidelines
Overtime is structured differently in different states. Arizona follows federal overtime guidelines and California follows California overtime guidelines. Workers in both states are entitled to time and a half pay for any time spent working over 40 hours in one work week. In addition, most California workers are entitled to overtime pay for any time spent working over 8 hours in a day, with double-time pay after 12 hours.
