Overtime
Many employers attempt to avoid paying overtime wages properly. By law, non-exempt employees working overtime must be compensated at 150% of their normal pay rate. Some employers have used underhanded and illegal techniques to avoid paying the fair overtime compensation mandated by employment and wage and hour law.
Workers in management positions are not required to be paid overtime. However, in an attempt to avoid paying deserved overtime pay, some employers may inappropriately assign management job titles to workers who do not have any actual managerial functions or responsibilities in an attempt to avoid paying them deserved overtime. Real managers are in a supervisory role and have the ability to influence personnel decisions. Employers may not add a manager title to a position that does not have manager functions in order to stop paying that position overtime.
Overtime is structured differently in different states. Arizona follows federal overtime guidelines while California follows its own overtime guidelines. Workers in both Arizona and California are entitled to time and a half pay for any time spent working over 40 hours in one work week. In addition, most California workers are entitled to overtime pay for any time spent working over 8 hours in a day, with double-time pay after 12 hours in a day.
