Whiplash Injury - Poorly Designed Head Restraints

The Insurance Institute for Highway Safety (IIHS) has identified numerous vehicles with headrests that provide inadequate protection from whiplash during accidents.  The IIHS's simulated crashes involved 87 SUVs, minivans and trucks from major manufacturers.  The majority of vehicles were rated as marginal or poor.  Those Vehicles with Marginal or Poor Seat and Head Restraint Ratings can be found here.

Deficient headrest design leads to increased risk of whiplash or other head/neck injury in auto accidents.  These types of injuries can be difficult to diagnose and treat properly.  Oftentimes, pain and stiffness can linger for extended periods of time, affecting most activities of daily life.  Head Trial Lawyer Jeffrey Billings had this to say:

"Most folks believe that a rear end collision causes the body inside the vehicle to be pushed forward.  This is incorrect.  When a vehicle is rear ended, the vehicle moves forward but the head is actually thrown backwards causing the neck to go into extension.  The headrest is designed to stop the backwards motion of the head. 

A properly designed headrest limits the severity and likelihood of neck injuries because the head will stop in a rear end collision  before the muscles and ligaments are stretched beyond their normal anatomical limit.  Adjusting the headrest so that it hits the middle of the head will help to prevent neck injuries."
