Product liability refers to the responsibility of each party involved in the manufacturing, marketing, and sale of the products you buy.  These faulty products can range from manufactured goods such as medicine, tools, food, cars, toys, asbestos, etc. to items as varied as gas, pets, real estate and maps.

Product liability law applies to three major problems: flaws in product design, defects in product manufacturing, and misinformation in product marketing.

If there is a flaw in the design of a product, consumers may be subject to unnecessary risk when using the product.  A widely known example of a product with a deadly design flaw is the Ford Pinto™.  Due to the poor design of the car, any Ford Pinto™ involved in a rear-end collision had a greater risk of a gas tank explosion and car fire.*  While the car served its purpose in getting people from one place to another, its use constituted a danger to the occupants.

Manufacturing defects can occur even if the design of the product is adequately safe.  Instead of all items being dangerous, only a few products may be flawed.  However, manufacturing defects are just as dangerous as poor design.  Tainted food supply could be considered an all-too-common form of a manufacturing defect.  Food poisoning, for instance, can arise from improper handling, storage, or preparation of food.  When eating food that is properly processed, there is almost no inherent danger in its consumption.  But if the standards of quality break down somewhere along the manufacturing line, the danger of injury rises dramatically.

Product liability law also applies to product marketing when products have improper instructions or fail to provide adequate warnings about the inherent dangers of its use.  News of marketing improprieties have filled headlines recently.  The prescription pain reliever Vioxx™ has been linked to adverse cardiovascular events in long term use.** Because Merck, the manufacturer, failed to warn consumers of the inherent danger in the long term use of Vioxx™, Merck has been forced to pay millions in damages and will continue to do so in the near future.***  Vioxx™ is not the only drug that has had some problems recently.  Product liability cases are also pending or in progress against the makers of Bextra™, Fen-Phen™, Fosamax™, Neurontin™, Ortho Evra™, Prempro™, Seroquel™, Trasylol™, and more.
